ARTIFICIAL INTELLIGENCE AND EXPRESS DECLARATION OF OPPOSITION /RESTRICTION 

ARTIFICIAL INTELLIGENCE and EXPRESS DECLARATION OF OPPOSITION /RESTRICTION in the use of works of the represented repertoire of APOLLON in this context.

APOLLON states that it is not opposed to or objected to the evolution and development of Artificial Intelligence. Artificial Intelligence offers excellent opportunities for music creators, who use it as a new tool to service their art.

But APOLLON explicitly expresses its will and wants to ensure that the works of its represented rightholders, i.e. musical works protected by copyright, do not become part of the development of Artificial Intelligence (AI) without their express consent. This includes but is not limited to language models, foundational models, artificial intelligence generation systems and recommendation algorithms. In this context, APOLLON, with the exercise of the right to opt-out, which it does hereby, aims to balance the rights of the represented rightholders and the intended actions in Artificial Intelligence. It is known that many AI tools base their training on various types of data, including protected works, which raises issues regarding respect for copyright, especially when creating training sets that include protected works from data mining.

In this context, APOLLON expressly declares that it restricts/excludes/does not allow the reproduction and extraction of the works of its represented repertoire for the purpose of text and data mining, in accordance with article 21B of Law 2121/1993 (which is an integration of article 4 of Directive (EU) 2019/790)).

Consequently, any such use of the works of the rightholders – musicians of APOLLON in the conduct of text and data mining requires the granting of the relevant license of APOLLON, unless otherwise provided by law.

APOLLON emphasises that the provision of art. 21b of Law 2121/93 and the relevant EU legislation, does not allow access to the conduct of text and data mining for the purposes of the development of artificial intelligence (AI). Therefore, based on the exception expressly stated above, the relevant rights with the above use are explicitly excluded from this kind of use.

Henceforth, data mining of works included in the represented repertoire of the members of APOLLON by entities that develop artificial intelligence tools and/or that train artificial intelligence requires prior approval and the granting of a relevant license by APOLLON, in order to ensure fair remuneration for the rightholders – musicians who represent
